The importance of civility in the practice of law
2023 JulyLast month, CAALA inducted into its Hall of Fame four fine lawyers: Gary Dordick, Carl Douglas, Gretchen Nelson, and Brian Panish. Each of these represents the highest ideals of civility in our profession.
The legal profession is built on principles that strive for justice, fairness, and respect for the rule of law. At the core of this noble pursuit lies the concept of legal civility, which refers to the courteous and respectful behavior exhibited by legal professionals throughout their practice. Legal civility fosters an environment of professionalism, cooperation, and effective dispute resolution. I’d like to explore the significance of legal civility in the practice of law and how it contributes to a fair and efficient judicial system.
Promoting professionalism
Legal civility plays a vital role in promoting professionalism within the legal community. Lawyers are not only representatives of their clients but also officers of the court. By maintaining civility, legal practitioners uphold the integrity and reputation of the profession. When lawyers treat each other with respect, it strengthens the public’s trust in the legal system. Professionalism also ensures that lawyers can collaborate effectively, fostering a cooperative atmosphere where legal issues are addressed efficiently.
Preserving the adversarial process
The adversarial nature of the legal system relies on opposing parties presenting their arguments and evidence before an impartial judge or jury. While vigorous advocacy is a cornerstone of this process, legal civility ensures that it remains fair and respectful. By adhering to standards of civility, lawyers can argue their cases passionately while refraining from personal attacks or disrespectful behavior. Let’s all try to emulate the careers and professionalism that Gary, Carl, Gretchen, and Brian exemplify. In doing so, each of us will do a part to better the profession that we love and cherish. And maybe one day, we may be so honored as to join Gary, Carl, Gretchen, and Brian in the Hall of Fame.
